Terms and Conditions

These terms apply to this website (www.guyaubertin.com) and to prints and digital images bought through it. They do not affect your statutory rights as a consumer. Last updated 18 September 2026.

About us

Guy Aubertin Photography, trading as Guy Aubertin Photography, based in Wokingham, Berkshire. Not VAT registered. You can contact me at [email protected].

Buying prints and digital images

1. Prices are as shown on the website [and include / exclude VAT where applicable]. If a clear pricing error is spotted I will contact you before fulfilling the order, and you may confirm or cancel.
2. Your order is an offer to buy. A contract is formed when I confirm your order or dispatch it, whichever is first.
3. Prints are made to order. Most are hand-printed by me on archival paper, so please allow [7 to 14 days] for printing before dispatch. Delivery timescales are estimates.
4. Delivery and risk. I deliver within the UK [and internationally by arrangement]. Postage is [shown at checkout / charged at cost]. Risk passes to you on delivery. Please check your order on arrival and tell me within [7 days] if anything is damaged or missing.
5. Cancellation and returns. Because prints are personalised and made to your order, they are exempt from the usual 14-day distance-selling cancellation right, so they cannot be returned simply because you have changed your mind. This does not affect your legal rights if an item is faulty, not as described or damaged in transit: contact me within [14 days] and I will replace or refund it. Digital downloads cannot be refunded once the download has begun, again except where they are faulty.
6. Print guarantee. Beyond your legal rights, if a professionally framed print of mine starts to fade while hanging on your wall, I will replace it free of charge and deliver it at my own cost. If the print is not framed, contact me and I will see what I can do.

Image licence and copyright

1. Copyright in all images remains with Guy Aubertin Photography at all times.
2. When you buy an image (print or digital download) you are granted a non-exclusive licence to use it for your own personal, non-commercial use only. You may not copy, reproduce, republish, post, broadcast, transmit, make available to the public, sell or otherwise commercialise the image in any way. No other licence is implied or granted without my written consent.
3. You may not edit, alter, adapt or add to an image, nor combine it with other material.
4. You may not use an image to promote, advertise, endorse or imply a connection between you (or any third party) and Guy Aubertin Photography, nor in any way that could bring the business into disrepute.
5. The reproduction by any means of the whole or any part of an image (including slide projection, artist's reference, illustration, layout or presentation) is not permitted without my specific written permission.
6. Commercial licence. A right to reproduce an image commercially arises only once commercial licence terms are agreed in writing and the related invoice is paid in full. Any reproduction before payment or outside the agreed terms is an infringement of copyright and a breach of these terms. Contact me if you need commercial, editorial or web-use rights.
7. Social media file. Where a licensed social media file is supplied, it carries a single-user, non-exclusive, non-transferable right to use the image on social media only. No other use, commercial use or distribution is granted without my written consent.

Photography bookings

Bookings for weddings, commercial and family photography are covered by a separate booking agreement. Please get in touch to discuss your day.

Liability

1. Nothing in these terms limits or excludes my liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law.
2. Nothing in these terms affects your statutory rights as a consumer, including your rights that goods are of satisfactory quality and as described, and that services are carried out with reasonable care and skill.
3. Subject to the above, my total liability arising from any order is limited to the price of the goods you have paid for. I am not liable for indirect or consequential loss.
4. The website and its content are provided on an "as is" basis. I take reasonable care over the site but do not guarantee it will always be error-free or uninterrupted.

Privacy

I handle your personal information in line with my Privacy Policy, which explains what I collect, how I use it and your rights.

General

1. You may not assign, charge, sub-license or otherwise deal with your rights or obligations under these terms.
2. If I do not enforce a right straight away, that is not a waiver of it.
3. These terms are governed by the law of England and Wales and subject to the exclusive jurisdiction of the English courts.
